The case against alleged paedophile Lord Janner will be heard in court, prosecutors are set to announce on Monday.
In a major U-turn, the Crown Prosecution Service will allow claims of historic child sex abuse by the ex-Labour MP to be put to a jury.
But it will be a trial of the facts – a rare device that allows evidence to be heard but where Janner will not testify.
The court can only impose a supervision or hospital order – or a defendant’s absolute discharge.
The decision to set up a trial of facts is a substantial reversal for the Director of Public Prosecutions Alison Saunders.
Ms Saunders ruled in April the peer should not be charged because of his dementia even though there was enough evidence to prosecute him for 22 sex offences against nine people.
Following an appeal by victims, an independent QC reviewed the decision and concluded the 86-year-old peer should face a trial of facts.
